1. What do these General Conditions cover?
1.1 This document defines the general operation of the Harlow Rugby Club web site.
2. Operation of your of this site.
2.1 The main connection to Harlow Rugby Club is made over the internet, hence you will be using technical devices belonging to a third party, (an Internet Service Provider - ISP) to issue instructions or to receive notices from Harlow Rugby Club. Any action or omission of that third party shall be considered to be yours.
2.2 You may acquire information (for which we have accepted you) once you have accessed Harlow Rugby Club web pages by providing your user name and any password. You may issue an instruction in writing or by electronic means, which will constitute valid consent to acquire a particular product. 2.6 Harlow Rugby Club shall be relieved of all responsibility for acting in accordance with instructions received under these General Conditions as long as they were accompanied by the proper username and any password and when requested, your memorable personal data. This applies even if carried out by an unauthorised third party, unless you have provided prior notice to Harlow Rugby Club of the loss, theft or public knowledge of your username, any password or memorable personal data.
2.7 If you report the loss, theft or public knowledge of your username, any password or memorable personal data, Harlow Rugby Club will enable you to change any pass number and/or memorable personal data using appropriate security measures.
2.8 Harlow Rugby Club will deal with the instructions you send as quickly as possible. Harlow Rugby Club reserves the right to take a reasonable time to check or analyse your instructions before executing them. It may reject those that do not comply with the formal or other requirements of applicable codes of practice, regulation, legislation or these conditions, as well as if any of the grounds for terminating these conditions have arisen.
2.9 Harlow Rugby Club does not make any commitment to maintain its services or have any responsibility for any system breakdowns or interruptions which affect computer or telephone systems, which impede or delay the execution of transactions, which arise as a result of breakdowns in the networks, systems or programs used, or any other reasons out of our control, network or system maintenance, unless they involve the wilful misconduct or gross negligence of Harlow Rugby Club.
2.10 Harlow Rugby Club may block your username on reasonable grounds, in particular if unsuccessful attempts are made to access your account.
2.11 Harlow Rugby Club reserves the right to suspend access to Harlow Rugby Club without prior notice if it becomes aware of illegitimate or improper use of the website.
2.12 Harlow Rugby Club may send you notices or advice by electronic means, or by post if required by law. Both you and Harlow Rugby Club shall notify the other, as soon as possible, of any amendment to the email or postal address provided for notification purposes. Until then, all notifications sent to the last known email or postal address shall be valid.
3. How much does access to Harlow Rugby Club cost?
3.1 Connection to Harlow Rugby Club is free of charge but any access, connection and Internet uses are fully payable by you
4. Right of Set-off
4.1 Should you default on any monies due to Harlow Rugby Club, we reserve the right of "set off". This means that funds or other assets held by Harlow Rugby Club on your behalf or by a third party in relation to the provision of services and products by Harlow Rugby Club and shall serve as a guarantee for any amounts owed to Harlow Rugby Club, who may retain such items until debts are paid, or realise their value for this purpose in accordance with applicable legislation. In the event of co-holders, the set-off shall effect the entire individual or joint balance of accounts and deposits held by Harlow Rugby Club.
5. Can these General Conditions be modified?
5.1 Harlow Rugby Club reserves the right to change these conditions. If the change is to your advantage, we may make the change immediately and tell you about it within thirty (30) days. If the change is neither to your advantage or disadvantage, we will always give you at least thirty (30) days' notice before making the change. If the change is to your disadvantage, we will tell you about it personally at least thirty(30)days before making the change. At any time up to sixty(60) days from the date of the notice you may, without notice, switch your account or close it without having to pay any extra charges or interest for doing this.
5.2 We will give you reasonable advance notice of not less than thirty (30) days before any change in the operations of Harlow Rugby Club service, which could affect you, such as the procedure for checking your account or sending instructions. We will do this by sending a message by electronic means.
6. Termination
6.1 If you fail to satisfy the above requirements at any time, we reserve the right to terminate these conditions and cancel the products that you have acquired that are in force at that time.
6.2 Harlow Rugby Club may terminate any or all products upon thirty (30) days notice and demand repayment of any amounts owed by you. In exceptional circumstances we reserve the right to give less notice.
7. General
7.1 These conditions do not oblige us to offer you or agree to accept your application for any product.
